Acceptance of Terms & Conditions

By using this Site you agree to be bound by its terms & conditions as described below.  Ascella reserves the right to change the content from time to time – users are encouraged to review contents before consenting to their use.  By using this Site, users indicate their complete acceptance and understanding of these terms and conditions. If users do not wish to abide by these terms and conditions, they should leave the Site immediately and cease use.  

By becoming a Friend of Ascella I understand I will receive each year two tasting packs as indicated above. I will continue to receive these packs until I advise Ascella Organic Wine in writing of my decision to cancel this membership. I agree to remain a member for a minimum of 24 months. Delivery instructions are my responsibility – Ascella will not be held liable for wines delivered to a previous address. I certify that I am over 18 years of age. I also understand that by providing my contact information I give Ascella Organic Wine permission to contact me periodically via mail, phone or email with future special offers and promotions for an indefinite period.

Ascella Organic Wine uses Eway's Internet Payment Gateway combined with an SSL Certificate to provide a secure environment for the authorization of credit card transactions over the Internet.

All confidential information including your credit card details are encrypted the moment they are transmitted from your browser to the banking network using industry standard SSL encryption technology.

These secure processes provide you with peace of mind when purchasing online. 

GST

All prices on this Site are inclusive of Australian Goods & Services Tax except where noted.

Promotional Codes

Each Friend of Ascella can use only one promotional code. Once used, the promotional code becomes an embedded part of the Friend of Ascella's profile.

Shipping

Ascella Organic Wine will do its best to ship orders quickly. Please note that Ascella does take orders for future delivery of new vintages that may not yet be available. Check availability carefully.

Small orders will be shipped by courier. Large orders may be shipped by commercial transport.

Guarantee

If customers are delivered faulty product by Ascella Organic Wine, and notify Ascella in writing within 14 days of delivery about the faults, Ascella will generally replace the product at no charge (as long as the customer has given the third party delivery service a safe mailing address). Ascella Organic Wine may request the wine be returned for analysis.

If customers are delivered damaged product by Ascella Organic Wine, and notify Ascella in writing within 7 days of delivery about the damage, Ascella will generally replace the product at no charge (as long as the customer has noted the damage on the delivery service packing slip).

If the wine has been purchased other than directly from Ascella Organic Wine it should be returned to the point of purchase.

Incorrect Orders

If customers make an incorrect order, Ascella will happily extend a credit to that customer for an alternate product.  In these cases, customers will be responsible for any additional shipping costs incurred by Ascella to complete the return process.

Ascella will do its best to rectify incorrect orders before the product is shipped, however it cannot guarantee it will be able to do so.  Customers are encouraged to contact Ascella as soon as they are aware of any error to increase the likelihood of this happening.  Customers should include their name, phone number and date of purchase in any communication with Ascella.

Ascella Organic Wine is not responsible for costs arising from incorrect shipping instructions. Please review ‘My Account’ to ensure all information is up to date and correct.

Out of stock

From time to time, often with little or no notice, specific products may no longer be available for purchase.  Ascella will endeavor, as reasonably as possible, to ensure up-to-date selling information is available on the Site, however this cannot be guaranteed.  In cases where customers place an order and a product goes out of stock before it may be shipped, Ascella will contact the customer to address the situation.

Depending on stock at the time of order, Ascella Organic Wine reserves the right to make minor substitutions of equal value to the tasting packs without notifying the customer.

Right to Change Site

Ascella reserves the right to change information on this Site at any time, either in whole or in part, without notice or delay.  These changes may include, but not be limited to, pricing, products, stock availability, and these terms & conditions. Customers are encouraged to review the site before making any purchase decisions.

Accuracy of Information on Site

Ascella shall not be responsible for any errors or omissions in information on this Site, regardless of their accuracy.  In cases where a product price is incorrect, Ascella reserves the right to either cancel or refuse any purchases, regardless of whether the transaction for the product’s sales was completed (confirmed via email, and customer charged for the product).  In cases where an order is cancelled, the customer may either use the amount as credit towards another purchase, or may elect to have the purchase refunded to them.  If the purchase was made via credit card, the customer’s card will be refunded.  For any other form of payment, Ascella will send a refund cheque via regular mail.

NSW Laws Applicable

Any legal disputes relating to this Site or its terms & conditions shall be governed by laws in existence from time to time in Australia.  Any such claims may only be dealt with in a court in New South Wales.

Legal Age in Purchase Jurisdiction

Users of this Site must be over the age of 18 or otherwise of legal drinks age in their purchase jurisdiction.  If you are not of legal drinking age, you must immediately leave this Site.

It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years
